Federal Court Mandates Release of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without lawful basis.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation stems from a mistaken removal to El Salvador in March, which the government later acknowledged was an mistake. Following his return to the United States to answer alien smuggling allegations, he was held in immigration detention.
In her order, the judge noted that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

The legal proceedings involve disputed claims. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in the state of Tennessee.
